NOTICE OF
RULEMAKING
The
New Mexico Department of Workforce Solutions (“Department” or “NMDWS”) hereby
gives notice that the Department will conduct a public hearing to receive
comments regarding proposed amendments to NMAC 9.1.1 (Administrative Procedures
for the Human Rights Bureau) at the Leo Griego Auditorium located in the State
Personnel Office (Willie Ortiz Building) at 2600 Cerrillos Road in Santa Fe,
New Mexico, 87505 on September 6, 2023 from 1:00 pm to
3:00 pm.
Summary: The proposed
amendment updates language to conform with the 2023 legislative changes in the
Human Rights Act to include removing gender specific language and the term
“handicap”. The amendment also proposes
procedural changes to the complaint process and the administrative hearing
process to include adding clarifications to due dates, methods of
correspondence, and electronic communications.
Under NMSA 1978 §§28-1-1 to 28-1-14
and 28-23-1 through 28-23-6, the Department is the agency responsible for the
Human Rights Bureau.

least thirty days prior to the hearing.
