NOTICE OF PUBLIC HEARING
The Construction Industries Commission will convene a public
hearing on the repeal and replacement of rule NMAC 14.7.2-- 2015 New Mexico Commercial
Building Code, NMAC 14.7.3—2015 New Mexico Residential Building Code, NMAC
14.7.7—2015 New Mexico Existing Building Code and amendments to NMAC
14.5.2—Permits, NMAC 14.7.4--2015 New Mexico Earthen Building Materials Code
and NMAC 14.7.8—2015 New Mexico Historic Earthen Buildings. The hearing will be
held before a hearing officer, at which time any interested person is invited
to submit data, views or arguments on the proposed changes, either orally or in
writing and to examine witnesses testifying at the hearing. The hearing is scheduled
for May 12, 2023.
The purpose of this public rule hearing is to receive public comments regarding the repeal and replacement of NMAC 14.7.2, 14.7.3 and 14.7.7 adopting the 2021 International Code with amendments and amendments to NMAC 14.5.2, 14.7.4 and 14.7.8 updating the General Building Codes.
The statutory authority for this rulemaking is found in the Construction Industries Licensing Act, NMSA 1978 Sections 60-13-1 through 59, specifically Sections 60-13-9, 60-13.10.3, 60-13-44, 60-13-45 and 60-13-47.
The hearing is scheduled as follows:
An in-person hearing shall be held on Friday, May 12, 2023, at the Toney Anaya Building, 2550 Cerrillos Road, Santa Fe, NM, second floor, Hearing Room #1, starting at 9:30 a.m. The hearing will remain open until 10:00 a.m. or until participants have an opportunity to make public comment, whichever is longer.

Summary of the Proposed Changes to the Administrative Codes:
14.5.2 NMAC – Permits, amends section 14.5.2.9(B) Exceptions to
Requirement for Permits for residential building amending requirements for
mechanical and plumbing work. Minor
formatting changes.
14.7.2 NMAC – 2015 New Mexico Commercial Building Code, repeal and replace with the 2021 International Commercial Building Code with amendments.
14.7.3 NMAC – 2015 New Mexico Residential Building Code, repeal and replace with the 2021 International Residential Building Code with amendments.
14.7.4 NMAC – 2015 New Mexico Earthen Building Materials Code, amends depth requirement for Count Rumford fireplace, adobe thickness and clarifies wall height requirements for earthen structures located in the IRC. Minor formatting and grammatical changes.
14.7.7 NMAC – 2015 New Mexico Existing Building Code, repeal and replace with the 2021 International Existing Building Code with amendments.
14.7.8 NMAC – 2015 New Mexico Historic Earthen Buildings, amends definition of “alteration”, “Energy Conservation: General”, “Repairs: Replacement glazing”, “Alterations: General”, “Change of Occupancy: General”, “Walls” and “Change of occupancy”.
